Look for Engagement Letters/Fee arrangements for Financial POA and Health Planning Documents

April 14, 2022 Listserve Request:

I recently established my own firm and I’m dipping my toe into this realm. I was wondering if anyone had any advice on what sorts of fee arrangements are best (by document, per hour, flat fee?) and whether they have any sample engagement letters they are willing to share?

Responses:

Mazel tov, Christine, as you embark on the adventure of solo practice! The CWBA offers great support to its members. I do hope you’re coming to the CWBA convention. Another great resource is the American College of Trust and Estate Counsel (ACTEC), even if you’re not a member. Check out ACTEC’s publication on engagement letters at https://www.actec.org/assets/1/6/ACTEC_2017_Engagement_Letters.pdf?hssc=1. Tailored to the trust and estate arena, including POAs and health planning arrangements, ACTEC’s sample engagement letters are easily adaptable to other areas of the law.
